We discuss the topic of familiarity customs violations. As we know, customs are a government organization and operates under the Ministry of Economy and Finance. In the country, there are laws for the entry and exit of goods, which are called customs laws and the violation of them is called smuggling.
The task of the customs organization is to implement the customs rules in trade with countries and export and import operations. If a person or a company disobeys the law, it will be subject to heavy fines and court orders.
Every country tries to prevent the smuggling of reckless goods to reduce its number to zero, but many countries like Iran have not succeeded in this field. Supervision of customs violations cannot be transferred to the private sector and non-governmental organizations; This is because the possibility of falsifying documents and party playing in this field is high and the government cannot take risks.
Many customs laws, such as clearance of goods, storage of goods and unloading, have been entrusted to the private sector, and companies have failed to implement them. Today, 3 new smart customs systems have been introduced in the discussion of information and communication technology, which have reduced the work duties of the customs organization and instead increased the supervision of other organizations on customs practices in order to add an element of transparency to these practices.
In the borders of the customs territory, there are areas called free zones, which do not follow the customs rules and observe the mechanisms specific to their region. So, customs rules do not include free zones.
Customs Free Zones without Customs Rules
Customs regulations refer to regulations, instructions and declarations that are valid in customs areas and the customs organization has the order to deal with them in its duties.
There are 3 Categories of Goods
1. Allowed Goods
It does not require legal formalities and the owner of the goods can import and sell it from the border of the country without paying any fees to the customs.
2. Conditional Goods
They are the goods that the customs work on and applies the legal formalities of the goods on them.
3. Prohibited Goods
There are goods that cannot enter the country under any circumstances. The entry of these goods into the country is smuggling and is considered a crime.
Procedure for Dealing with Customs Violations
The Customs Organization has formed a commission to resolve disputes related to goods, their valuation, and fines for violations. This commission, which is called the commission for dealing with customs disputes, is managed by individuals. These people include employees from different ministries of the country who are experts in their work and know customs laws well. The members of the Customs Dispute Resolution Commission have hired employees who have at least 15 years of experience in their previous jobs.

The decision issued by this commission must be implemented and the parties to the dispute are forced to accept it. Unless the difference between the dispute resolution commission and customs is more than 5 million tomans. In this case, an appeal should be applied to the dispute resolution request. Of course, disputes between natural and legal persons with the customs are raised with the headquarters units of the customs.
If they could not solve the existing problem and dispute, the customs dispute resolution commission comes into work. In order for disputes to be registered in the Customs Dispute Resolution Commission, the owner of the goods must pay half percent of the disputed amount with the customs, otherwise the amount approved by the customs is valid.

Customs violations are either due to the clear violation of customs laws or due to the import and export of prohibited goods, which are investigated under the title of smuggling. To deal with such violations, customs dispute resolution councils have been established, which are composed of employees of different ministries. Lack of familiarity with customs laws and regulations as well as laws governing trade and transportation can open the door to customs violations for our business.
